Documentation and Promotion of the Competition and the Results Thereof:
The organizers (the Ars Electronica and the ORF – Austrian Broadcasting Company’s Upper Austria Regional Studio) and sponsors of the 2009 Prix Ars Electronica desire to make the results of the competition accessible to as large an audience as possible. To achieve this end, a public relations campaign aimed at particular media outlets (press, radio, TV and Internet) will be conducted.

The works singled out for recognition by the juries will be documented (as a whole or in part) in the following media:

  • "CyberArts 2009 - International Compendium Prix Ars Electronica 2009 "
    This volume describes the works selected by the juries in texts (German/English) and graphics.
  • DVD "Prix Ars Electronica CyberArts 2009” featuring selected works from the 2009 Prix Ars Electronica as well as .pdf files from the Prix Ars Electronica CyberArts 2009 volume.
  • Prix Ars Electronica CD containing the prizewinning works in the Digital Musics category
  • Ars Electronica website (www.aec.at)
  • The ORF will produce a documentary TV program about the prizewinning projects and the awards ceremony.

If the submitted work is honored with a Golden Nica (cash prize) or an Award of Distinction prize, the material will be used in the catalog, DVD, CD and on the Ars Electronica website; accordingly, entrants are respectfully requested to prepare graphics and texts meticulously and to submit them in the best possible quality. Furthermore, entrants hereby consent to participate in the production of the planned documentary TV program and to convey the rights necessary to do so. The catalog, the DVD and the CD will be issued in conjunction with the 2009 Ars Electronica Festival. In order to promote the Festival and the Prix Ars Electronica, the website will go online prior to their being held.

Participants convey to ORF as co-organizer with respect to television documentation the non-exclusive rights free of temporal or geographic restriction to broadcast (and to rebroadcast any number of times) via television (terrestrial, cable, and satellite including propagation via cable within the area of television reception) in and from Austria, on 3sat and BR Alpha, as well as the non-exclusive rights to video-on-demand usage on websites operated by ORF independently or jointly with others (for example, orf.at).
Furthermore, ORF is entitled, within the framework of the rights conveyed hereby, to use and/or exploit excerpts from the production free of temporal or geographic restriction (and to reuse them any number of times) on television or online in conjunction with ORF productions, particularly for purposes of information dissemination and promotion.
The participants guarantee that they rightfully dispose over the rights hereby conveyed to ORF and, above all, that they have obtained from all persons depicted in these materials consent that these materials be used or exploited in the ways foreseen in this agreement. In exercising the rights conveyed to it by this agreement, ORF will be indemnified and held harmless with respect to any and all claims or demands lodged by any and all third parties.

The catalog, the DVD and the CD will be issued in conjunction with the 2009 Ars Electronica Festival. In order to promote the Festival and the Prix Ars Electronica, the website will go online prior to their being held.
Due to technical and organizational constraints, the organizers of the Prix Ars Electronica reserve the right to determine the actual extent, timing and layout/editing of the above-mentioned publications and documentaries.

The Prix Ars Electronica is an integral part of the Ars Electronica Festival, in conjunction with which the organizers intend to present, display or host a performance of the works honored by the respective juries. The organizers reserve the right to determine which works will be included in such exhibitions. The entrants hereby consent to making their works available for this purpose.

It is planned to hold a concert performance of the prizewinning works in the Digital Musics category. If the organizer decides to do so, then the entrant consents to perform the prizewinning work during the Festival in Linz. The organizers reserve the right to determine which works will be performed in this way.
An Ars Electronica Animation Festival featuring electronic theater is staged each year. Entrants in the Computer Animation / Film / VFX category hereby consent to convey to the organizers all the rights necessary to publicly present their entries in this context.
The Ars Electronica Linz GmbH reserves the right to present the Ars Electronica Animation Festival in further contexts.

Special copyright provisions apply to the Award for Media.Art.Research.

The Ars Electronica Linz GmbH is a permanent facility for the exhibition of digital media art; therefore, the Ars Electronica Linz GmbH intends to make the Prix Ars Electronica accessible to interested members of the public both on site and on the Internet. Entrants hereby consent to all submitted material being included in the Ars Electronica Internet archive as well as being publicly displayed as part of exhibits in the Ars Electronica.

Entrants hereby consent to the submitted material, as a whole or in part, being used, stored to a data storage medium, and/or made public on the Internet or via some other digital medium by the Ars Electronica Linz GmbH (AEC)or by a third party authorized by the AEC for purposes of public relations, advertising & promotion, documentation, archiving or scientific research. In using such works, the AEC will accord all due consideration to the legitimate interests of the entrant but assumes no statutory duty in this connection. The rights conveyed to the AEC are unlimited with respect to their subject matter, their timeframe and their geographical location, but are limited to the purpose of the conveyance of rights.

The organizers and sponsors, for their part, hereby assure competition participants that the submitted works will be used only in the ways enumerated above. Any commercial use by the organizers or sponsors outside of the scope of the Prix Ars Electronica is strictly prohibited.
The artists retain all copyrights.

The entrant hereby declares that he/she is legally authorized to convey such rights to the extent stipulated above, that he/she has obtained any and all necessary consent from third parties as called for by regulations governing copyright, personal property rights or other such legal provisions, and that he/she is prepared to provide proof of such at any time if called upon by the AEC to do so.

Additional stipulations with regard to the conveyance of rights within the framework of agreements concluded in conjunction with participation in the Prix or the Festival supplement the rights conveyed in this agreement but do not limit them in the absence of an express written agreement to the contrary.

This agreement elaborating the terms of participation in the Prix is governed by Austrian law with the exception of the United Nations Convention on Contracts for the International Sale of Goods and all norms serving as legal reference (Verweisungsnormen). The place of jurisdiction is Linz.

RIGHTS - MEDIA.ART.RESEARCH AWARD

Documentation and Promotion of the Competition and the Results:
The organizer of the Prix Ars Electronica (Ars Electronica Linz GmbH, hereinafter referred to as AEC), the organization that has endowed the Prix Ars Electronica Media.Art.Research category (Ludwig Boltzmann Institute Media.Art.Research, hereinafter referred to as LBI) and the sponsors of the 2009 Prix Ars Electronica are desirous of presenting the results of this competition to as wide an audience as possible. Accomplishing this calls for a well-designed promotional campaign involving print media, radio, TV and the Internet.

Works honored with the Prix Ars Electronica Media.Art.Research Award will be presented (together with the additional material that accompanied the entry and with proper attribution of the name/s of /s) in the following media:

  • “CyberArts 2009 - International Compendium Prix Ars Electronica 2009” – This book describes works singled out for recognition by the competition juries in word (German and English) and image.
  • DVD "Prix Ars Electronica CyberArts 2009” featuring selected works from the 2009 Prix Ars Electronica as well as .pdf files from the Prix Ars Electronica CyberArts 2009 volume.
  • Website of the LBI (http://media.lbg.ac.at)
  • Website of the AEC (www.aec.at)
  • The ORF – Austrian Broadcasting Company will produce and air a TV documentary about the winning project and the awards ceremony.

Entrants are therefore requested to prepare their graphic and text material with consummate care and to submit it in the best possible quality. Furthermore, entrants expressly consent to cooperating on the production of the planned TV documentary and to granting the rights necessary for it to be made and aired. The catalog will be published in conjunction with the 2009 Ars Electronica Festival.

Due to technical factors and organizational constraints, the organizer of the Prix Ars Electronica (AEC) and the organization that has endowed the Prix Ars Electronica Media.Art.Research Award (LBI) retain the right to determine the actual scope, timing and physical form, design, layout, etc. of the above-mentioned publications and documentations.

The copyright of and the right to use the long version of the scholarly work submitted as an entry in the Prix Ars Electronica Media.Art.Research Award category remain the property of the author/s. Only the additional material will be used for publication in conjunction with Ars Electronica (AEC) and by the LBI. Non-published works will be shown to jury members; they will not be made public in any other way.
The Ars Electronica Linz GmbH is a permanent facility for the exhibition of digital media artworks. Accordingly, the Ars Electronica Linz GmbH intends to make the additional material submitted together with entries to the Prix Ars Electronica and the Prix Ars Electronica Media.Art.Research Award category available to interested members of the public both on site and in the Internet. AEC and LBI reserve the right to publicly display all additional material (with proper attribution of the name/s of the author/s) in the Internet archives of Ars Electronica and of the LBI as well as in exhibits of the Ars Electronica Linz GmbH.
The AEC and the LBI may use the additional material for purposes of promotion, PR, advertising, documentation and archiving, may save it or parts of it to data storage media, and may make it available to the public including via the Internet or other digital media. The rights thus granted to the AEC and the LBI are not limited to a specific activity or to a particular time or place, but they cannot be used for any purposes other than the ones for which they were granted.

The organizer of the Prix Ars Electronica (AEC), the organization that has endowed the Prix Ars Electronica Media.Art.Research Award (LBI) and the sponsors, for their part, hereby assure competition participants that their entries and additional material submitted will be used only in the ways described above. Any and all commercial use beyond the scope of the Prix Ars Electronica by the AEC, LBI or sponsors is strictly prohibited. The artists retain all copyrights.

The entrant hereby declares that he/she has the legal authority to grant such rights to the extent called for above, that he/she has secured any and all necessary consent from any and all third parties in accordance with the law of copyright, the law of personality right, or any other legal provisions, and will, upon request at any time, provide proof of such to the AEC and the LBI.

Additional contractual provisions granting rights that are agreed to among the parties in conjunction with participation in the Prix Ars Electronica or the Festival Ars Electronica supplement this agreement with respect to granting rights but do not restrict it in any way unless there is an express written agreement to the contrary.
This agreement governing participation in the Prix Ars Electronica is subject to Austrian law with the exception of the United Nations Convention on Contracts for the International Sale of Goods and also excluding any and all principles on conflicts of law. The place of jurisdiction is Linz.

The rights provisions enumerated for this category differ from those of other Prix Ars Electronica categories. In the case of a conflict between two sets of provisions, the provisions that have been specially enumerated for the Prix Ars Electronica Media.Art.Research Award take precedence.
